TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF PEPTIDE MIND AND ITS AFFILIATES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

17. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Informal Resolution: Before filing any formal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Site ("Dispute") by contacting us through peptidemind.com/contact. We will attempt to resolve the Dispute informally for at least thirty (30) days from the date we receive your written notice.

Binding Arbitration: If the Dispute is not resolved within thirty (30) days, either party may elect to resolve the Dispute through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Delaware, or at another mutually agreed location, by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AND PEPTIDE MIND AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

Jury Trial Waiver: IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND PEPTIDE MIND EACH WAIVE ANY RIGHT TO A JURY TRIAL.

Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes within the jurisdiction of such court.

Injunctive Relief: Nothing in this section shall prevent Peptide Mind from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights or other proprietary rights.

18. Termination

We reserve the right to suspend or terminate your access to the Site at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, suspected fraudulent or illegal activity, or conduct that we determine to be harmful to other users or to Peptide Mind.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3, 4, 5, 6, 9, 10, 11, 16, 17, and 19 through 25.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

20. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by Peptide Mind on the Site, constitute the entire agreement between you and Peptide Mind regarding your use of the Site and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, with respect to the Site.

21. Waiver

No waiver by Peptide Mind of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition. Any attempt by you to assign or transfer these Terms without such consent will be null and void. Peptide Mind may freely assign or transfer these Terms without restriction and without notice to you, including in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of its assets.

23. Force Majeure

Peptide Mind shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, pandemics, or any other event beyond Peptide Mind's reasonable control.

24. International Use

The Site is operated from the United States. If you access the Site from outside the United States, you do so at your own risk and are solely responsible for compliance with all applicable local, national, and international laws and regulations. We make no representation that the Content on the Site is appropriate or available for use in any particular jurisdiction. Access to the Site from jurisdictions where the Content is illegal or restricted is prohibited.

25. No Professional Relationship

Nothing in these Terms or on the Site shall be construed to create any professional relationship between you and Peptide Mind, including but not limited to a doctor-patient, attorney-client, or advisor-advisee relationship.
